關(guān)于實(shí)施《海底電纜管道管理規(guī)定》的通知

沿海省、自治區(qū)、直轄市人民政府、國務(wù)院有關(guān)部門,總參通信兵部、海軍: 國務(wù)院于1989年2月15日發(fā)布第27號令,公布了《鋪設(shè)海底電纜管道管理規(guī)定》,并于1989年3月1日起施行。為便于海底電纜管道鋪設(shè)活動中的申報和管理,現(xiàn)將有關(guān)事項通知如下: 一、國內(nèi)企業(yè)、事業(yè)單位鋪設(shè)海底電纜管道路由的調(diào)查、勘測和路由的確定以及鋪設(shè)活動分別由所在的國家海洋局北海、東海、南海分局、海南省海洋局和廈門管區(qū)具體承辦審批,并由審批單位負(fù)責(zé)對鋪設(shè)活動進(jìn)行監(jiān)督管理。所報文書資料抄報國家海洋局備案; 軍事部門鋪設(shè)的海底電纜、管道,分別由國家海洋局各海區(qū)分局或管區(qū)審批;涉及軍事秘密的,審批機(jī)關(guān)按保密規(guī)定妥善處理。 二、外國的公司、企業(yè)和其他組織或個人以及中外合資企業(yè),在中國海域鋪設(shè)海底電纜、管道的各種活動由國家海洋局審批管理,各海區(qū)分局、省局、管區(qū)負(fù)責(zé)對海上鋪設(shè)活動實(shí)施監(jiān)督管理; 三、鋪設(shè)海底電纜、管道的單位,應(yīng)在海底調(diào)查、勘測和鋪設(shè)活動前15天,將具體實(shí)施計劃(包括航線、位置、到位時間、船舶呼號等)報各海區(qū)分局、省局、管區(qū),作業(yè)船舶應(yīng)于每天十點(diǎn)報告當(dāng)時船舶位置,如有變動應(yīng)及時通知; 四、國家海洋局所屬“中國海監(jiān)”船舶和飛機(jī)及其海洋監(jiān)察人員有權(quán)對上述活動進(jìn)行監(jiān)督和檢查;必要時,海洋監(jiān)察人員可隨勘測、施工船舶進(jìn)行監(jiān)督和檢查。有關(guān)企業(yè)、事業(yè)單位、組織和個人,應(yīng)為公務(wù)人員執(zhí)行公務(wù)提供方便; 五、在《鋪設(shè)海底電纜管道管理規(guī)定》公布之前鋪設(shè)的海底電纜、管道的有關(guān)資料(路線圖、位置表及說明材料),應(yīng)在接此通知后,整理報送國家海洋局和所在海區(qū)分局、管區(qū),以便受到法律保護(hù),涉及軍事秘密的,按保密規(guī)定辦理。 以上事項,望通告所屬有關(guān)單位遵照執(zhí)行。

第一條 為維護(hù)中華人民共和國國家主權(quán)和權(quán)益,合理開發(fā)利用海洋,有秩序地鋪設(shè)和保護(hù)海底電纜、管道,制定本規(guī)定。 第二條 本規(guī)定適用于在中華人民共和國內(nèi)海、領(lǐng)海及大陸架上鋪設(shè)海底電纜、管道以及為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測及其他有關(guān)活動。 第三條 在中華人民共和國內(nèi)海、領(lǐng)海及大陸架上鋪設(shè)海底電纜、管道以及為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測及其他有關(guān)活動的主管機(jī)關(guān)是中華人民共和國國家海洋局(以下簡稱主管機(jī)關(guān))。 第四條 中國的企業(yè)、事業(yè)單位鋪設(shè)海底電纜、管道,經(jīng)其上級業(yè)務(wù)主管部門審批同意后,為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測等活動,依照本規(guī)定執(zhí)行。 外國的公司、企業(yè)和其他經(jīng)濟(jì)組織或者個人需要在中華人民共和國內(nèi)海、領(lǐng)海鋪設(shè)海底電纜、管道以及為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測等活動,應(yīng)當(dāng)依照本規(guī)定報經(jīng)主管機(jī)關(guān)批準(zhǔn);需要在中華人民共和國大陸架上進(jìn)行上述活動的,應(yīng)當(dāng)事先通知主管機(jī)關(guān),但其確定的海底電纜、管道路由,需經(jīng)主管機(jī)關(guān)同意。 第五條 海底電纜、管道所有者(以下簡稱所有者),須在為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測實(shí)施60天前,向主管機(jī)關(guān)提出書面申請。申請書應(yīng)當(dāng)包括以下內(nèi)容: (一)所有者的名稱、國籍、住所; (二)海底電纜、管道路由調(diào)查、勘測單位的名稱、國籍、住所及主要負(fù)責(zé)人; (三)海底電纜、管道路由調(diào)查、勘測的精確地理區(qū)域; (四)海底電纜、管道路由調(diào)查、勘測的時間、內(nèi)容、方法和設(shè)備,包括所用船舶的船名、國籍、噸位及其主要裝備和性能。 主管機(jī)關(guān)應(yīng)當(dāng)自收到申請之日起30天內(nèi)作出答復(fù)。 第六條 海底電纜、管道路由調(diào)查、勘測完成后,所有者應(yīng)當(dāng)在計劃鋪設(shè)施工60天前,將最后確定的海底電纜、管道路由報主管機(jī)關(guān)審批,并附具以下資料: (一)海底電纜,管道的用途、使用材料及其特性; (二)精確的海底電纜、管道路線圖和位置表以及起止點(diǎn)、中繼點(diǎn)(站)和總長度; (三)鋪設(shè)工程的施工單位、施工時間、施工計劃、技術(shù)設(shè)備等; (四)鋪設(shè)海底管道工程對海洋資源和環(huán)境影響報告書; (五)其他有關(guān)說明資料。 主管機(jī)關(guān)應(yīng)當(dāng)自收到申請之日起30天內(nèi)作出答復(fù)。 第七條 鋪設(shè)施工完畢后,所有者應(yīng)當(dāng)將海底電纜、管道的路線圖、位置表等說明資料報送主管機(jī)關(guān)備案,并抄送港監(jiān)機(jī)關(guān)。 在國家進(jìn)行海洋開發(fā)利用、管理需要時,所有者有義務(wù)向主管機(jī)關(guān)進(jìn)一步提供海底電纜、管道的準(zhǔn)確資料。 第八條 海底電纜、管道的鋪設(shè)和為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測活動,不得在獲準(zhǔn)作業(yè)區(qū)域以外的海域作業(yè),也不得在獲準(zhǔn)區(qū)域內(nèi)進(jìn)行未經(jīng)批準(zhǔn)的作業(yè)。 第九條 獲準(zhǔn)施工的海底電纜、管道在施工前或施工中如需變動,所有者應(yīng)當(dāng)及時向主管機(jī)關(guān)報告。如該項變動重大,主管機(jī)關(guān)可采取相應(yīng)措施,直至責(zé)令其停止施工。 第十條 海底電纜、管道的維修、改造、拆除和廢棄,所有者應(yīng)當(dāng)提前向主管機(jī)關(guān)報告。路由變動較大的改造,依照本規(guī)定重新辦理有關(guān)手續(xù)。 外國船舶需要進(jìn)入中國內(nèi)海、領(lǐng)海進(jìn)行海底電纜、管道的維修、改造、拆除活動時,除履行本條第一款規(guī)定的程序外,還應(yīng)當(dāng)依照中國法律的規(guī)定,報經(jīng)中國有關(guān)機(jī)關(guān)批準(zhǔn)。 鋪設(shè)在中國大陸架上的海底電纜、管道遭受損害,需要緊急修理時,外國維修船可在向主管機(jī)關(guān)報告的同時進(jìn)入現(xiàn)場作業(yè),但不得妨害中國的主權(quán)權(quán)利和管轄權(quán)。 第十一條 海底電纜、管道的路由調(diào)查、勘測和鋪設(shè)、維修、拆除等施工作業(yè),不得妨害海上正常秩序。 海底電纜、管道的鋪設(shè)或者拆除工程的遺留物,應(yīng)當(dāng)妥善處理,不得妨害海上正常秩序。 第十二條 鋪設(shè)誨底電纜、管道及其他海上作業(yè),需要移動已鋪設(shè)的海底電纜、管道時,應(yīng)當(dāng)先與所有者協(xié)商,并經(jīng)主管機(jī)關(guān)批準(zhǔn)后方可施工。 第十三條 從事海上各種活動的作業(yè)者,必須保護(hù)已鋪設(shè)的海底電纜、管道。造成損害的應(yīng)當(dāng)依法賠償。 其他海洋開發(fā)利用和已鋪設(shè)的海底電纜,管道的正常使用發(fā)生糾紛時,由主管機(jī)關(guān)調(diào)解解決。 第十四條 主管機(jī)關(guān)有權(quán)對海底電纜、管道的鋪設(shè)、維修、改造、拆除、廢棄以及為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測活動進(jìn)行監(jiān)督和檢查。對違反本規(guī)定的,主管機(jī)關(guān)可處以警告、罰款直至責(zé)令其停止海上作業(yè)。 前款所列處罰的具體辦法,由主管機(jī)關(guān)商國務(wù)院有關(guān)主管部門制定。 第十五條 為海洋石油開發(fā)所鋪設(shè)的超出石油開發(fā)區(qū)的海底電纜、管道的路由,應(yīng)當(dāng)在油(氣)田總體開發(fā)方案審批前報主管機(jī)關(guān),由主管機(jī)關(guān)商國家能源主管部門批準(zhǔn)。 在海洋石油開發(fā)區(qū)內(nèi)鋪設(shè)平臺間或者平臺與單點(diǎn)系泊間的海底電纜、管道,所有者應(yīng)當(dāng)在為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測和施工前,分別將本規(guī)定第五條、第六條規(guī)定提供的內(nèi)容,報主管機(jī)關(guān)備案。 第十六條 鋪設(shè)、維修、改造、拆除、廢棄海底電纜、管道以及為鋪設(shè)所進(jìn)行的路由調(diào)查、勘測活動,本規(guī)定未作規(guī)定的,適用國家其他有關(guān)法律、法規(guī)的規(guī)定。 第十七條 中華人民共和國軍用海底電纜、管道的鋪設(shè)依照本規(guī)定執(zhí)行。軍隊可以制定具體實(shí)施辦法。 第十八條 主管機(jī)關(guān)應(yīng)當(dāng)收集海底地形、海上構(gòu)筑物分布等方面的資料,為海底電纜、管道的鋪設(shè)及其調(diào)查、勘測活動提供咨詢服務(wù)。 第十九條 本規(guī)定中的“電纜”系指通信電纜及電力電纜;“管道”系指輸水、輸氣、輸油及輸送其他物質(zhì)的管狀輸送設(shè)施。 第二十條 本規(guī)定由中華人民共和國國家海洋局負(fù)責(zé)解釋。 第二十一條 本規(guī)定自1989年3月1日起施行。

Whole Document (法規(guī)全文) PROVISIONS GOVERNING THE LAYING OF SUBMARINE CABLES AND PIPELINES (Adopted by the 32nd Executive Meeting of the State Council on January 20, 1989, promulgated by Decree No. 27 of the State Council of the People's Republic of China on February 11, 1989, and effective as of March 1, 1989) Article 1 These Provisions are formulated in order to safeguard the sovereignty and the rights and interests of the People's Republic of China, to carry out rational exploitation of seas and oceans, and to lay in an orderly way and protect submarine cables and pipelines. Article 2 These Provisions shall apply to the laying of submarine cables and pipelines in such areas as inland seas, territorial seas and continental shelves under the jurisdiction of the People's Republic of China, and also to the investigations and survey of routes and other relevant activities conducted for the aforesaid engineering projects. Article 3 The competent authorities for the administration of the laying of submarine cables and pipelines in such areas as the said inland seas, territorial seas and continental shelves, and also for the investigations and survey of routes and other relevant activities for the aforesaid engineering projects, shall be the State Oceanographic Bureau of the People's Republic of China (hereinafter referred to as "the competent authorities"). Article 4 When China's enterprises or institutions plan to lay submarine cables and pipelines, they shall file an application with their superior authorities for examination and approval before they conduct investigations and survey of routes and other relevant activities for the aforesaid engineering projects in accordance with these Provisions. When foreign companies, enterprises and other foreign economic organizations or individuals have the necessity to lay submarine cables and pipelines, and also to conduct investigations and survey of routes and other relevant activities for the aforesaid engineering projects in the inland seas and territorial seas of the People's Republic of China, they shall, in accordance with these Provisions, apply to the competent authorities for approval; if they have the necessity to carry out the said activities on the continental shelves of the People's Republic of China, they shall notify the competent authorities in advance, but the routes they have selected and decided on for laying the cables and pipelines must have the consent of the competent authorities. Article 5 The owners of the submarine cables and pipelines (hereinafter referred to as "the owners") shall file a written application with the competent authorities 60 days before they start the investigations and survey of routes for laying the submarine cables and pipelines. The written application shall contain the following: (1) the name, nationality, and residence of the owner; (2) the name, nationality, and residence as well as the chief person-in- charge of the unit which will conduct the investigations and survey of the routes for laying the submarine cables and pipelines; (3) the precise geographical areas in which the investigations and survey are to be conducted for laying the submarine cables and pipelines; (4) the time, the items, methods and equipment - including the ship to be used: its name, nationality, tonnage, and major pieces of equipment and their functions - for conducting the investigations and survey of routes for laying the submarine cables and pipelines. The competent authorities shall make a reply within 30 days as of the date of receipt of the application. Article 6 After the investigations and survey for laying the submarine cables and pipelines have been completed, the owners shall submit a report, delineating the final decision on the routes for laying the submarine cables and pipelines 60 days before the laying project is started, to the competent authorities for examination and approval, and the report shall be submitted together with the following data: (1) the purposes of laying the submarine cables and pipelines, the materials to be used and their properties; (2) the precious route chart and position chart of the submarine cables and pipelines, their starting point and terminal point, their relay points (stations) and their total length; (3) the construction contractor, time and plan for construction, and technical equipment; (4) a report on the repercussions of the cable-and pipeline-laying engineering project on marine resources and environment; (5) other explanatory data. The competent authorities shall make a reply within 30 days as of the date of receipt of the application. Article 7 After the completion of the engineering project, the owners shall submit all the explanatory data, such as the route chart and position chart of the submarine cables and pipelines, to the competent authorities for the record, and send duplicates to the harbour superintendence organs. When the State needs the relevant technical data for the exploitation of marine resources or for carrying out administration, the owners have the obligations to provide the competent authorities with further precise data concerning the submarine cables and pipelines. Article 8 The operations of laying submarine cables and pipelines and the investigations and surveying activities for the cable-and pipeline-laying engineering project shall not conducted beyond the approved sea areas; nor shall operations and activities other than these approved be conducted in the approved sea areas. Article 9 In the event that changes or modifications in the approved operation plan for laying the submarine cables and pipelines are required before the operations start or during the operations, the owners shall report the case to the competent authorities in good time. If the changes or modifications are of sizable proportions, the competent authorities may take appropriate measures accordingly, up to ordering the owners to cease the operations. Article 10 With respect to such operations as maintenance, alteration, dismantling, or abandonment of the submarine cables and pipelines, the owners shall submit a report on the said operations to the competent authorities in advance. If a relatively big change is to be effected in the routes of the submarine cables and pipelines, the owners shall go through the relevant procedures of application once again. When foreign vessels have the necessity to enter China's inland seas and territorial seas to carry out activities in the maintenance, alteration, or dismantling of submarine cables and pipelines, the owners shall, in addition to going through the procedures as prescribed in the first paragraph of this Article, submit an application to the administrative department concerned in China for approval, in accordance with the pertinent provisions of China's laws. When the damaged submarine cables and pipelines laid on China's continental shelves need emergency repairs, foreign maintenance vessels may enter the site to start the emergency repairs simultaneously with a report submitted to the competent authorities. However the said operations shall not impair China's sovereign rights and jurisdiction. Article 11 Operations such as the investigations and surveying activities for identifying the routes for laying submarine cables and pipelines, the laying, maintenance, and dismantling, must not hamper the normal order of marine navigation and transportation. The bits and pieces left over from the engineering project of laying submarine cables and pipelines and from the dismantling project shall be disposed of carefully and must not hamper the normal order of marine navigation and transportation. Article 12 When the laying of submarine cables and pipelines and other marine engineering operations require that those submarine cables and pipelines already laid be moved, prior consultations must be conducted with the owners of the aforesaid installations and an approval must be obtained from the competent authorities before the said engineering project starts. Article 13 Operators who are engaged in various activities at sea must protect the submarine cables and pipelines that have already been laid. Those who have caused damages to the said installations shall make compensations according to law. In the event that disputes arise over the exploitation of the seas and oceans and the normal functioning of submarine cables and pipelines, the disputes shall be mediated and handled by the competent authorities. Article 14 The competent authorities shall have the power to supervise and inspect the laying, maintenance, alteration, dismantling and abandonment of submarine cables and pipelines as well as the relevant investigations and surveying activities conducted for the laying of submarine cables and pipelines. The competent authorities may impose on violators of these Provisions such penalties as warning, fine, up to an order to cease their operations at sea. The specific measures for imposing the penalties as mentioned in the preceding paragraph shall be formulated by the competent authorities in conjunction with other competent authorities concerned under the State Council. Article 15 The plan for determining the routes for laying submarine cables and pipelines beyond the petroleum exploitation zones in order to exploit marine petroleum resources shall be submitted to the competent authorities prior to the examination and approval of the overall plan for the exploitation of oil (and gas) fields; and the competent authorities shall give approval after consultation with the competent state authorities for energy resources. With respect to the laying of submarine cables and pipelines within the marine petroleum development zones between the drilling platforms or between drilling platforms and single berthing points, the owners shall, before the start of the investigations and survey of routes for the laying of submarine cables and pipelines and the start of cable-and pipeline- laying operations, submit a report specifying the contents as provided in Article 5 and Article 6 of these Provisions to the competent authorities for the record. Article 16 With respect to the operational activities such as laying, maintenance, alteration, dismantling and abandonment of submarine cables and pipelines, as well as the investigations and surveying activities conducted for identifying the routes for laying the submarine cables and pipelines, in case there are any aspects which are not covered in these Provisions, the Provisions in other relevant State laws, decrees and regulations shall apply. Article 17 The laying of submarine cables and pipelines for military purposes in the People's Republic of China shall be handled in accordance with these Provisions. The armed forces may formulate specific rules for the implementation of these Provisions. Article 18 The competent authorities shall collect data concerning submarine topography and the distribution of structures at sea in order to offer consultancy services for laying of submarine cables and pipelines, and for conducting relevant investigations and surveying activities. Article 19 The term "cables", as used in these Provisions, refers to communications cables and electric cables; the term "pipelines" refers to the pipe-shaped conveying and transporting installations used for conveyance of water, gas, oil and other substances. Article 20 The right to interpret these Provisions resides in the State Oceanographic Bureau of the People's Republic of China. Article 21 These Provisions shall go into effect on March 1, 1989.
